Paris Sues Hallmark -- You Care Enough to Rip Me Off

TMZ has obtained a lawsuit filed by Paris Hilton against Hallmark Cards, claiming they used her likeness without permission. Not cool!

In the lawsuit, filed yesterday in Federal District Court in Los Angeles, the heiress alleges Hallmark created a card entitled "Paris's First Day as a Waitress." The card features a picture of Paris' face superimposed over a cartoon of a waitress serving food that says "Don't touch that, it's hot. What's hot? That's hot."

Paris is suing for damages in excess of $100,000, claiming Hallmark "failed to properly obtain [her] approval." Guess not!

A rep for Hallmark told TMZ "Some of Hallmark's new humor greeting cards are parodies of today's most popular celebrities and politicians. These cards take a satirical look at news and gossip surrounding these public figures, including Paris Hilton, and we do not believe Hallmark has violated any of Ms. Hilton's rights."

Yes, that makes since. Unfortunately quotes, stories, events, happenings, pictures are always at the mercy of being reported in a distorted manner by different media outlets because they aren't always 'getting the facts straight' before submitting them, or committing them to "print," to present to the public. Photos never give a balanced representation of celebs because no one knows what is actually happening at that very moment, and it's usually just a candid shot for anybody to pick apart, and speculate on. And you're right.., some people (huh, well a lot actually) do believe anything, and everything that is given to their disposal, instead of stepping back and thinking about it a bit more. Plus, (well, and worse) they also seem to get so emotionally involved with despising a publicized person that they truly know nothing personally about. They tend to think that the celebrity in question is 'so transparent,' or that the person is actually bearing every bit for the public to see all of what they offer. People just take it and go, the gossip, the images, the stories... What gets me at times is how many do feel, "well that's the price, of being a celebrity," or "that's part of it, if they want it, they've got to have it." Pfft. No one deserves that sort of treatment, and it's not a clause in the contract, so-to-say.

I completely hear what you're saying. Plus with someone in that position there is only so much that you can really let slide or others will run with it and take a mile. If Paris was not to stick up for it, then quite possibly someone later could take advantage of it, and come back in defense, "well nothing was done beforehand, so it's alright to use this for that." Business wise, it's best to protect something that you've adopted/created, especially if it is trademarked as some reports have made mention. Actually this very story didn't even need to be made public.

Good post. But you overlook one very important point. “Celebrities” like Ms. Hilton ask the public to buy into them, literally. She is really someone who is just “famous for being famous,” yet asks us to buy her merchandise based on the public persona she displays. She is not a legitimate, professional actress or singer, etc. We know her by the image she has thrust into the public’s view through her public displays and infamous use of the media. One cannot expect someone to “buy into” something they know to be false, without catching a lot of flack and negative reaction from the public as a result.

125. Well, I didn't think it would last long.... Paris gets out of jail professing that she's a changed human being. "OOOOhhh I want to help, wherever I can" or words close to that. You are just showing us that you have NOT changed, and WILL NOT EVER change. It's all about the money and recognition. You're not fooling anyone, Paris !!! With so many people taking your picture every day... and you don't sue them for publishing your photo or "likeness"... what gives? Just another little sad, spoiled rich kid that thinks she can run roughshod over anyone she doesn't like that particular day.

127. Its so sad to see people still hating on this Young Women. Paris Hilton really doesnt need her grandfathers money she has her own. Her parents r is still behind her 100% so we all need to fine something better to do besides hate on her. I can say no one in the room has more money then she has and will never be a Paris hilton so get a life. If someone puts your face on something and u didnt want it there and didnt know about it what would you say. Sometimes we has human beings need to sit back and think about what would we do. Paris is changeing her image and we all need to let go of the past. how has she effected you? non at all so grow up. I am sure we all have done things in the past we wouldnt want know one to know about. It not her fault she was raise in a family that has more money then the average. Remeber Paris looks at u all and laughs out loud.
