Paris Sues Hallmark -- You Care Enough to Rip Me Off

TMZ has obtained a lawsuit filed by Paris Hilton against Hallmark Cards, claiming they used her likeness without permission. Not cool!

In the lawsuit, filed yesterday in Federal District Court in Los Angeles, the heiress alleges Hallmark created a card entitled "Paris's First Day as a Waitress." The card features a picture of Paris' face superimposed over a cartoon of a waitress serving food that says "Don't touch that, it's hot. What's hot? That's hot."

Paris is suing for damages in excess of $100,000, claiming Hallmark "failed to properly obtain [her] approval." Guess not!

A rep for Hallmark told TMZ "Some of Hallmark's new humor greeting cards are parodies of today's most popular celebrities and politicians. These cards take a satirical look at news and gossip surrounding these public figures, including Paris Hilton, and we do not believe Hallmark has violated any of Ms. Hilton's rights."

That all depends on the context. They are not using the "trademark" in a situation that the trademark filing served to protect in the first place...this isn't clothing, accessories, perfume, etc. Also, "that's hot" is not a unique phrase. Actually, despite Ms. Hiltons' constant and inane uttering of these two words in public, it's a phrase that's been used for decades, so Ms. Hilton cannot claim ownership of those two words...hence, the parody.

By the way, a trademark is not the same as a copyright.

Did Hilton’s attorneys contact Hallmark about this complaint before filing the suit? All they had to do was to replace her photo with a caricature similar to the very unflattering one they already have of Ms. Hilton on another card pictured in an orange jumpsuit behind bars, with the title, “It’s a simple, simple, life.” I suspect that it’s the other card that really has Hilton upset…this lawsuit sounds like it’s more about sour grapes, $$, and more media coverage than it is about principle.

110. We can solve several problems at once with paris hilton. We could send her to Iraq and she could have sex with all the men in Iraq, which she would love to do, and she would give them her sexually transmitted diseases. The men would be too weak from disease to fight and the fighting would be over. People in America would be happy and the troops could come home. paris would sure be happy and I understand drugs are in great supply in Iraq so she would get an additional bonus over the sex. We would be rid of paris while she is doing her little job in Iraq.

I thought about that too Lisa initially, when I first heard of this. And you know, maybe that is her intentions, but really it's none of our business what she plans on doing, giving it to charity, or not. Deep down, that only matters to her. I wouldn't judge her for it rather if she did, or didn't. But really it would be a waste of energy, effort, and funds to take this to court. She should just be able to laugh it off, and move on. She may be concerned that if she doesn't protect her "saying", or "ideas" that they may become used for other's gains later on. That may be where the real problem lies. But I'm not going to give it anymore thought. I'll stand by my first comment.

I would agree with you on the "let it slide aspect", but remember all the things she has "let slide" in the past? They are the false or distorted things all the people who are criticizing her now are using to attack her on this site and other places. Unfortunately some people believe everything they read in tabloids, internet blogs, and gossip sites etc, but "public people" can't sue as easily for defamantion of charachter as private citizens can.

Also, the internet and digital photography has exacerbated this situation where it's basically a free-for-all against celebs. privacy laws have not caught up with what can happen on the internet and when digitally altered photos and videos are posted. celebs are basically subjected to wholesale charachter assination. Look at all the haters posting away. I'm sure the vast majority have never met this person, but they just continue rehashing falsehoods that they believe. As the saying goes, ..lies run a sprint while truths must run a marathon.

117. Isn't Paris' face and the "That's Hot" comment public domain? If she copyrighted the statement, then she'll have a case. If they themselves drew a picture of the likeness, then it's ok because she's a celbrity (People magazine would be out of business if not). If they wrote a card that she liked, then there wouldn't be much more than a deal about who gets royalties.

She's a child, and acts like one. Ask her what the 'spiritual' thing to do would be...

118. Her likeness is plastered all over news reports, and websites like TMZ, with the intent to draw viewers, and ultimately obtain revenue.
If that were my face, I would wear a paper bag outdoors.

Instead of "that's hot", I think Paris Hilton should have copywrited the phrase, "Paris sucks".
That way she would have soooo many people to sue, everytime someone gave an opinion.
