Paris Sues Hallmark -- You Care Enough to Rip Me Off

TMZ has obtained a lawsuit filed by Paris Hilton against Hallmark Cards, claiming they used her likeness without permission. Not cool!

In the lawsuit, filed yesterday in Federal District Court in Los Angeles, the heiress alleges Hallmark created a card entitled "Paris's First Day as a Waitress." The card features a picture of Paris' face superimposed over a cartoon of a waitress serving food that says "Don't touch that, it's hot. What's hot? That's hot."

Paris is suing for damages in excess of $100,000, claiming Hallmark "failed to properly obtain [her] approval." Guess not!

A rep for Hallmark told TMZ "Some of Hallmark's new humor greeting cards are parodies of today's most popular celebrities and politicians. These cards take a satirical look at news and gossip surrounding these public figures, including Paris Hilton, and we do not believe Hallmark has violated any of Ms. Hilton's rights."

46. Shanna & Travis going strong??? HAHAHAHA don't make me loose my dinner, going strong is when both parties ACTUALLY WANT TO BE IN THE RELATIONSHIP not just being forced by constant whining,crying,begging, having your father call him to lay down the guilt trip, doing it for the "kids" sake....

Travis doesn't even open the car door for her anymore when they are out & did you see the video of them going & coming from dinner - if you call that going strong, I'll call Kim Kardashian a VIRGIN.

back to Paris, Hallmark is one of the largest corporations in the world, for them to try and free-ride off her, even in the most minute way- she had every right to sue them.

When I read this I just couldn’t believe it. Jackie Collins – “a long-time Hilton family friend” – is the one who conducted the interview with Paris for UK Elle. (That sure explains a lot.)

What follows is taken directly from another interview with Jackie Collins by Lisa Johnson Mandell:

“It seems Jackie is the consummate charmer. ……… She’ll smile warmly as she confesses that she loved Paris Hilton’s album; that she thinks she’s a good example for young women because she dropped out of school at 15, never went to college and was still able to become wildly successful.”

Thankfully, many of us have higher standards for the young women of our country.

52. This nation is building a culture of thievery. Hallmark WAS a reputable company. I am amazed they would stoop so low as to steal like this. Paparazzi are another low breed of human stealing another's image for profit and usually degrading use. I loath paparazzi, but Hallmark is something else. Hallmark needs to pay huge and Paris should put the money in an interest bearing account with which to sue others who steal from her.

54. She's only cool with her pic when it's free publicity or when she's hawking her funky products. She needs to lighten up, AT LEAST she's still getting the attention she loves and craves so much. SHE should be paying HALLMARK for the free publicity!

58. EXACTLY. Makes you wonder how Hallmark thought they could get away with it.

It's not even about the money .Just because some posters here may resent Paris Hilton does not mean she has no legal rights.

Hallmark will probably settle on this one because it is a clear copyright violation.

I, like others, think that Paris should and probably will have her lawyers go after some of the people who post outright lies about her on the web.. It's way overdue.

But when they put her picture on the card and put her name on it PLUS the trademarked sentence That's Hot right by her name - it will cost them.

It's probably been a long time since someone took on Hallmark but it serves them right.
I also hope that Paris will go after offenders on the web, some comments are clear out of reason and deliberately false.

Her lawyers started exactly doing that , but it seems they got side tracked with the jail sentence. Now that's out of the way and all it will take is a few good lawsuits to let haters know she means business.

Even if she does not win in every case, the real losers will be the people who have to hire their own lawyers against the Hilton lawyers. Paris has deep pockets.It's the American way, baby. When someone sues it can ruin the person who gets sued.

60. Sorry, people, but let the courts decide...it will be far more judicial and intelligent than the decisions these "armchair" attorneys post in defense of Hilton.

I see that 73% of the voters thus far have voted for Hallmark...not just because they think that Hallmark is “in the right,” legally, but quite obviously because the majority of people simply do not have any respect for this woman.
