Paris Sues Hallmark -- You Care Enough to Rip Me Off

TMZ has obtained a lawsuit filed by Paris Hilton against Hallmark Cards, claiming they used her likeness without permission. Not cool!

In the lawsuit, filed yesterday in Federal District Court in Los Angeles, the heiress alleges Hallmark created a card entitled "Paris's First Day as a Waitress." The card features a picture of Paris' face superimposed over a cartoon of a waitress serving food that says "Don't touch that, it's hot. What's hot? That's hot."

Paris is suing for damages in excess of $100,000, claiming Hallmark "failed to properly obtain [her] approval." Guess not!

A rep for Hallmark told TMZ "Some of Hallmark's new humor greeting cards are parodies of today's most popular celebrities and politicians. These cards take a satirical look at news and gossip surrounding these public figures, including Paris Hilton, and we do not believe Hallmark has violated any of Ms. Hilton's rights."

36. I can't believe so many people make comments about the Paris Hilton card without having any idea what they are talking about. Paris does not simply give away pictures and never has. Do you give away your products for free? And the Jerry Falwell case was a completely different situation and did not involve the copyright on a photo. Do you people look at a picture of Paris Hilton and then automatically become stupid just so you can make a negative comment about something you are obviously without any knowledge of. I bet you did the same thing when Paris went to jail, even though every legal expert that commented said Paris should never have gone to jail. Karma will get you. Every time you make a false accusation about another person, the true blame is back in your face.

37. I've been thinking about suing Hallmark for using my likeness (and attitude) to create Maxine cards! I shall watch the unfolding of this case very closely. Bet I could get a class action going with my other Maxine-like friends.

39. Paris certainly can sue Hallmark for using her image unauthorized. Hallmark has been in trouble before using another card company's image years ago and was sued. Hallmark lost. I don't know about the "That's hot" comment though, as to my knowledge she hasn't had that trademarked or anything, but she can force the issue on her image. They will have to pay up or drop the image and cards.

That is so untrue. A lot of experts thought she deserved that sentence -- and largely because they had all of the facts -- not the sanitized version Paris and her PR people expect the public at large to swallow. "Oh, it was just for driving on a suspended license." Absolute BS.

she's so rich and yet she needs more money? for what her drug habbit... she needs to go to some NA (Narcotics Annon) or AA meetings... i used to have 'substance' abuse issues to but i don't anymore thanks to real friends, and don't whats RIGHT!

45. True. She trademarked "That's Hot" on February 13, 2007. It is "infringement of a federally registered trademark". Easy money.
